1. Agreement to Terms

By accessing or using Luma ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

Luma is a photo and video sharing platform for events. These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

Luma provides a platform that allows users to:

• Create events for photo and video sharing
• Generate QR codes for guest access
• Collect photos and videos from event guests
• Display uploaded media in galleries and slideshows
• Download collected media files

The Service is provided on a one-time payment basis for each event, with different pricing tiers offering varying features and storage limits.

3. Account Registration

To use certain features of the Service, you must register for an account. When you register, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your password
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use

You must be at least 18 years old to create an account. We reserve the right to refuse service or terminate accounts at our discretion.

4. Payment and Pricing

One-Time Payments: Luma operates on a one-time payment model. You pay once per event based on your selected plan (Essential, Premium, or Deluxe).

Pricing: All prices are listed in USD. Prices are subject to change with notice. Any price changes will not affect existing paid events.

Payment Processing: Payments are processed securely through our payment provider, Lemon Squeezy. We do not store your payment information.

Upgrades: You may upgrade your plan at any time during your event period. The upgrade fee will be the difference between your current plan and the new plan. Partial refunds for previous plan charges may apply.

5. Refund Policy

Pre-Event Cancellation: If you cancel before your event date, you are eligible for a full refund.

Post-Event: No refunds are provided once your event has started or the event date has passed.

Service Issues: If you experience technical issues that prevent normal use of the Service, contact us at hello@luma.events within 7 days. We will work to resolve the issue or provide a refund at our discretion.

6. Content Ownership and License

Your Content: You retain all ownership rights to photos, videos, and other content you or your guests upload to the Service ("User Content").

License to Luma: By uploading User Content, you grant Luma a limited, non-exclusive, royalty-free license to store, process, and display your content solely for the purpose of providing the Service. This license ends when you delete your content or close your account.

Guest Uploads: By creating an event and sharing the QR code, you represent that you have obtained necessary permissions from guests to collect and store their uploaded content.

Prohibited Content: You may not upload content that is illegal, infringing, defamatory, obscene, or violates any third-party rights.

7. Storage and Data Retention

Event access periods vary by plan:

• Essential: 1 month active event
• Premium: 6 months active event
• Deluxe: 1 year active event

After your event period expires, your content will be deleted from our servers. We strongly recommend downloading all media before expiration.

Storage extensions may be available for an additional fee. Contact support for more information.

8. Acceptable Use

You agree NOT to use the Service to:

• Violate any laws or regulations
• Infringe on intellectual property rights
• Upload malicious code, viruses, or harmful software
• Harass, abuse, or harm others
• Spam or send unsolicited communications
• Attempt to breach security or interfere with the Service
• Use automated tools to access or scrape the Service
• Resell or redistribute the Service without permission

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LUMA SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, or consequential damages
• Loss of data, profits, or business opportunities
• Service interruptions or technical issues
• Content uploaded by users or third parties
• Unauthorized access to your account

Our total liability shall not exceed the amount you paid for the specific event in question.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability or fitness for a particular purpose
• Warranties of uninterrupted or error-free service
• Warranties regarding data accuracy or reliability
• Warranties that the Service will meet your requirements

11. Account Termination

By You: You may delete your account at any time through your account settings. Paid events will remain accessible until their expiration date.

By Us: We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or misuse the Service.

12. Modifications to Service and Terms

We reserve the right to modify or discontinue the Service at any time, with or without notice. We are not liable for any modifications, suspensions, or discontinuations.

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the new Terms. Material changes will be notified via email.

13. Governing Law
